Terms of Service

Governing platform usage, digital perpetual commercial licenses, Shopify 2.0 theme archives, and consumer rights. Last updated: October 16, 2026.

Preamble & Corporate Identity

These Terms of Service ("Agreement") constitute a legally binding agreement between you (the "Customer" or "User") and Cresfield Capital LLC, a Delaware Limited Liability Company with registered office at 16192 Coastal Highway, Lewes, Delaware 19958, United States, operating the Wantedmarkets digital marketplace platform ("Wantedmarkets", "we", "us", or "our").

By accessing our catalog, registering an account, or downloading any theme archive, you expressly acknowledge and agree to be bound by these Terms without qualification or exception.

1. License Scope & Commercial Rights

Wantedmarkets delivers perpetual, non-exclusive, worldwide commercial licenses to use, modify, and deploy clean Shopify Online Store 2.0 theme architectures. Customers are granted perpetual rights to install and operate the theme architecture on live Shopify stores, develop on staging environments, and customize all Liquid, JSON, CSS, and JavaScript source code included within the archive.

Web developers and agencies are authorized to customize and deploy themes for client stores without paying recurring royalties, seat fees, or gross revenue percentage deductions.

2. Statutory Compliance & Title 17 U.S. Code § 102(b)

Under Title 17 of the United States Code, Section 102(b): "In no case does copyright protection for an original work of authorship extend to any idea, procedure, process, system, method of operation, concept, principle, or discovery, regardless of the form in which it is described, explained, illustrated, or embodied."

Software architecture, layout compositions, responsive column divisions, e-commerce functional systems, and UX flows are non-copyrightable functional mechanisms. Theme names and design references cited within the Wantedmarkets catalog constitute Nominal Fair Use strictly to identify technical rendering compatibility with the Shopify 2.0 engine.

3. Instant Digital Delivery & Right of Withdrawal Waiver

Wantedmarkets products consist of digital software archives (.ZIP) containing full uncompiled source code. Delivery is executed immediately and in-memory upon confirmation of payment via Stripe.

In accordance with Directive 2011/83/EU of the European Parliament (Article 16(m)) and applicable international consumer standards, the statutory 14-day right of withdrawal does not apply to contracts for the supply of digital content not provided on a tangible medium once performance has begun. By validating an order and initiating the download, the Customer expressly acknowledges and agrees to the immediate execution of the contract and waives their statutory right of withdrawal.

★ Non-Tangible Digital Goods Notice: Due to the nature of software source code, all purchases are strictly final upon delivery.

4. All Sales Strictly Final & Zero Returns

Because software code and theme archives are intangible digital goods delivered instantly and uncompiled, all sales are strictly final. Wantedmarkets does not accept returns, refunds, or product exchanges. Customers are responsible for verifying theme compatibility and specifications prior to checkout.

5. Payment Security & Fraud Prevention

All financial transactions are processed securely through Stripe US Direct certified infrastructure (PCI-DSS Level 1 compliance) using 256-bit TLS encryption, dynamic 3D-Secure 2.0 verification, and automated tokenization. Wantedmarkets does not store, intercept, or handle raw payment card numbers.

6. Prohibited Activities & Anti-Redistribution

While commercial deployment on personal and client stores is fully licensed, the following actions remain strictly prohibited:

7. "AS IS" Warranty Disclaimer & Technical Support

Except as expressly provided herein, all digital archives are delivered on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied. Wantedmarkets provides dedicated 24/7 technical support for archive integrity, upload assistance, and Shopify 2.0 schema validation.

8. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Cresfield Capital LLC, Wantedmarkets, its directors, officers, or affiliates be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including lost profits, goodwill, or business interruption. In all circumstances, our aggregate cumulative liability shall be strictly capped at the total amount paid by the Customer for the specific transaction giving rise to liability.

9. Governing Law & Exclusive Jurisdiction

This Agreement and any dispute arising out of or related to platform usage shall be governed by, construed, and enforced in accordance with the laws of the State of Delaware and the federal laws of the United States, without regard to conflict of law principles. The Customer submits to the exclusive personal jurisdiction and venue of the state and federal courts located in the State of Delaware.
